End-User License Agreement

License terms governing use of the LupaDólar application.

Effective date: 29 July 2025

This End-User License Agreement (the “Agreement”) is a legal contract between you (“you”, “user”) and LupaDólar (“we”, “us”). By installing or using the LupaDólar mobile application or related services (collectively, the “App”), you acknowledge that you have read, understood, and agree to be bound by this Agreement.

1. License Grant

We grant you a personal, limited, revocable, non-transferable, and non-exclusive license to install and use the App on devices that you own or control and that are associated with your Apple App Store or Google Play account. You may not:

  • Copy, distribute, sell, lease, or sublicense the App or any data provided by it.
  • Reverse engineer, decompile, disassemble, or otherwise attempt to derive source code or underlying datasets except where expressly permitted by law.
  • Use automated means (scrapers, bots, bulk exporters) to extract or reproduce content beyond the intended in-app functionality.

2. Eligibility

You represent that you are legally permitted to install and use mobile applications in your jurisdiction. If you are a minor, you confirm that you have permission from a parent or legal guardian to use the App and to accept this Agreement on your behalf.

3. Account & Security

You are responsible for maintaining the confidentiality of any credentials and for all activity that occurs under your account. Notify us immediately at [email protected] if you suspect unauthorized use.

4. Subscription & Billing

Premium functionality is sold through auto-renewing subscriptions handled by the Apple App Store or Google Play Store. By purchasing a subscription you agree to the applicable store terms.

  • Billing cycle: Unless explicitly stated, subscriptions renew monthly until canceled.
  • Payment authorization: Your store account is charged at confirmation and at each renewal period.
  • Cancellation: Manage or cancel subscriptions directly in the App Store or Google Play settings. We cannot cancel on your behalf. Cancellation takes effect at the end of the current billing cycle.
  • Trials & promotions: Free trials automatically convert to paid plans unless canceled before the trial ends.
  • Refunds: Refunds are issued solely by Apple or Google under their own policies.

5. Updates & Availability

We may provide automatic updates, enhancements, or bug fixes. Certain updates may be required for continued use. We may modify, suspend, or discontinue the App (in whole or part) at any time, with or without notice.

6. Acceptable Use

You agree not to:

  1. Circumvent, disable, or interfere with security-related features.
  2. Upload malware, attempt to access other users’ data, or disrupt the service.
  3. Use the App to engage in unlawful, fraudulent, misleading, or competitive intelligence activities.
  4. Misrepresent exchange-rate information provided by the App.

Violations may result in immediate suspension or termination without refund.

7. Data & Privacy

Use of the App is subject to our Privacy Policy, which explains how we collect and process personal information. The App may rely on third-party APIs or data providers; you consent to the transfer of data necessary to operate the service.

8. Intellectual Property

All rights, title, and interest in the App—including datasets, charts, trademarks, and trade dress—remain exclusively with LupaDólar (owned and operated by Luis Galindo). This Agreement does not grant you any ownership rights. Feedback or suggestions may be used without obligation or compensation.

9. Disclaimers

The App is provided “as is” and “as available.” We make no warranties—express or implied—regarding accuracy, timeliness, merchantability, fitness for a particular purpose, or non-infringement. Exchange-rate data can change rapidly and should be independently verified before executing financial transactions. You understand that any trades, conversions, or financial decisions you make after viewing the App are undertaken at your own risk, and that LupaDólar does not guarantee that the displayed data is complete, up to date, or suitable for your purposes.

10. Limitation of Liability

To the fullest extent permitted by law, LupaDólar, its affiliates, and licensors are not liable for indirect, incidental, punitive, or consequential damages, loss of profits, data, goodwill, trading opportunities, or business opportunities. In no event shall our total liability exceed the amount you paid for the subscription during the preceding three (3) months. Some jurisdictions do not allow limitations on implied warranties or liability, so these restrictions may not apply to you in those areas.

11. Termination

We may suspend or terminate your access if you breach this Agreement, fail to pay required fees, or if we discontinue the App. You may stop using the App and cancel subscriptions at any time; fees paid before termination are non-refundable unless required by the App Store or Google Play policies.

12. Governing Law & Dispute Resolution

This Agreement is governed by the laws of the Republic of Peru, without regard to conflict-of-law rules. Any dispute will be submitted to the competent courts of Lima, Peru, except where local law requires a different forum. Nothing prevents either party from seeking injunctive relief for misuse of intellectual property.

13. Changes to this Agreement

We may update these terms occasionally. Material changes will be announced via the App or our website. Continued use after changes take effect constitutes acceptance of the revised Agreement.
